Terms of Service

In order to access or use any of our Services, you may be required to log in and create an account either as a user (“Account”). To be eligible to create an Account, you must provide your full legal name and have a valid and unique email address.

In addition to general user Accounts, there are a few other Account categories, which may have different eligibility criteria that will be disclosed to you during the Account registration process:

• Head of Household Accounts. If you are the head of your household, you may create an Account designating you as the Head of Household. To be the Head of Household, you must be of legal age in your state of residence.
• Minor Accounts. If you are younger than the legal age in your state of residence, then you may set up an Account as a minor. Minor Accounts may have more limited features and functionalities, and you may have to grant access to the Account or share your information with adult members of your family circle.
• Professional Advisor Accounts. You can also join the Forward Platform as an attorney, financial advisor, or CPA and perform actions authorized by a Head of Household.

When you create an Account, you represent and warrant that all of the registration information you submit will be true, accurate, current and complete, and that you will maintain the accuracy of such information. If any of your registration information is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your Account, and refuse any ongoing or future access to or use of any portion of the Forward Platform.

You also agree to provide any information or documentation reasonably requested by us to verify your identity and other information provided by you. You agree that we or our agents may contact third parties, including consumer reporting agencies, to verify such information and prevent fraud.

We may offer access to certain financial products and services through the Forward Platform, either offered by Forward or through third parties (“Financial Services”). Accessing these Financial Services may be subject to additional eligibility requirements and to additional terms and conditions, which will be disclosed to you before you sign up. We do not guarantee that you will qualify or be able to use any particular Financial Service, even if your Account is in good standing.

As part of the Account registration process, you may be asked to provide information such as your name, email address, as well as set a password.

You are responsible for maintaining the security of the login credentials for your Account. Your Account may include personal and sensitive information, including financial information, and you should treat your login credentials, such as your name, email or password as confidential. You are responsible for all activity that occurs under your Account, including any activity by unauthorized users. If you become aware of unauthorized access to your Account, change your password and notify us immediately through email to stewards@forwardinheritance.com. We will not be liable for any loss or damage arising from your failure to comply with this Section.

You can permanently delete your Account at any time by following the prompts in your Account in the Forward Platform.

We can terminate or suspend your Account, and/or deny your access to all or any portion of the Forward Platform or the Services, at any time, without prior notice, and at our sole discretion. If we terminate or suspend your Account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party. In addition to terminating or suspending your Account, if you have engaged in any conduct that we believe violates any portion of these Terms, violate our rights or those of any third party, violate any laws or regulations, or is inappropriate, then we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.

We aim to build a modern inheritance hub for you and your family, to track your home equity, assets, and financial opportunities for you and your family.

When you create an Account, you may designate other users as members of your family circle, and you may be linked to one or more family circles. You acknowledge that when you add other users to your family circle, you are sharing all of your Account information with such other user.

In support of elderly family members, your Account may also have features that allow other users to access your Account for certain purposes and for certain periods of time.

In each case, you agree that if you add other users to your family circle, or if you grant access to your Account to another user, even temporarily, you are doing so at your own risk.

To give you a full picture of your family's financial condition, you may choose to link your external account(s) maintained at a third-party financial institution to your Account (such external account, “Linked Account”), as well as documents such as your estate planning documents. By linking Linked Accounts and updating such information, you authorize us to access or collect certain financial data from each of these sources, including, without limitation, account balances, transaction dates, the merchants involved, the transaction types and amounts, other information, data, passwords, or other content (collectively “Financial Data”) in accordance with our Privacy Policy.

We may use service providers to gather data from external financial institutions. By using our Services, you grant us and these service providers the right, power, and authority to act on your behalf to access and transmit your personal and financial information from the relevant financial institution. You agree to your personal and financial information being transferred, stored, and processed by these service providers in accordance with their privacy policies.

By linking any Linked Account(s), you represent and warrant to Forward and its service providers that you are the legal owner of the Linked Account(s), that you have the right to disclose your login credentials for such Linked Account(s) if needed, and that you have the right to grant the authorizations in this Section with regard to such Linked Account(s). You acknowledge that the services provided by these service providers are provided “as is” and for general informational purposes only. You acknowledge that Forward and its service providers are not responsible and are not liable for any acts, errors, or omissions by the financial institutions at which you maintain your Linked Account(s), or for the accuracy, completeness, availability or timeliness of the information provided by such institutions, or for any investment or other decisions you make using the information provided.

In addition, you authorize Forward, its service providers and any of our non-affiliated third-party partners to use, display or distribute any of the Financial Data for any of our Services, including to operate, provide, administer, develop, enhance, improve, measure, personalize and market the Services or any other products or services that may be available to you through the Forward Platform. You also authorize Forward and its third-party partners to use Financial Data, and Consumer Report Data, where “permissible purpose” exists under the FCRA, in order to determine your eligibility for any Services that may be provided by or through Forward. Forward and its service providers and third-party partners may, on an aggregated and anonymized basis, use, modify, display, distribute and create new material using the Financial Data and the Consumer Report Data in order to provide you with Services. We reserve the right to remove, delete, block, edit or modify any Financial Data and Consumer Report Data in our possession at any time, subject to applicable regulatory retention requirements, without prior notice and in our sole discretion for any reason or no reason. Forward and its service providers and third-party partners may also, on an aggregated and anonymized basis, use, license, reproduce, distribute, and disclose any information about you, your activities and behavior that is derived through your use of the Services or the Forward Platform. You agree that, without any particular time limit, and without the payment of any fees, Forward and its service providers and third-party partners may use the Financial Data and the Consumer Report Data for the purposes set out above.

By using our Services, you may receive content from time to time based on your Financial Data. Any such content is for informational purposes only. You should not construe any information or materials provided by Forward as legal, tax, investment, financial, or other advice. Nothing contained in our Forward Platform constitutes a solicitation, recommendation, endorsement or offer by Forward or any third party service provider to buy or sell any securities or other financial instruments in any jurisdiction.

All content on the Forward Platform is information of a general nature and does not address the circumstances of any particular individual or entity. Nothing in the Forward Platform constitutes professional and/or financial advice, nor does any information on the Forward Platform constitute a comprehensive or complete statement of the matters discussed or the law relating thereto. Forward is not a fiduciary by virtue of any person's use of or access to the Forward Platform or content published on the Forward Platform. You alone assume the sole responsibility of evaluating the merits and risks associated with the use of any information or other material on the Forward Platform before making any decisions based on such information or other materials. In exchange for using the Forward Platform, you agree not to hold Forward, its affiliates or any third-party service provider liable for any possible claim for damages arising from any decision you make based on information or other materials made available to you through the Forward Platform.

The Forward Platform may provide users with access to products or services offered by Forward's third-party partners, which may include offers for financial or non-financial products and services, or rewards or savings on purchases (such offers, “Third-Party Offers”). Third-Party Offers may be offered to you based on information you have provided to Forward and may be offered to you at no additional cost or for a specified fee. We do not guarantee that you will be presented with Third-Party Offers for any particular types of products or services or that you will meet the eligibility or approval criteria for any particular Third-Party Offer. It is entirely your choice whether to apply for a Third-Party Offer and you do so at your own risk. While checking for Third-Party Offers does not result in a hard inquiry or affect your credit score, you confirm that you understand that if you choose to apply for a Third-Party Offer with a third-party partner, that partner may run a hard inquiry, which can impact your credit score.

You acknowledge that Forward does not provide, nor does it warrant or guarantee, any Third-Party Offer. All rates, fees, and terms are subject to change pursuant to each third-party partner's discretion, and may not be available in all states or for all types of products offered. There is no guarantee that you will be approved or qualify for the advertised rates, fees, or terms presented. The third-party partners providing these products, services or information are solely responsible for them, as well as other content on their websites or mobile applications. Forward is not liable for any third party's failure with regard to those advertised products, services, or information. If you choose to access or use any third-party products, services, information, websites, or mobile applications, you understand that such access or use will be subject to the terms and conditions and privacy policies of the appropriate third-party partner, and not to these Terms. Your interactions and business dealings with third-party partners are solely between you and the third party. You should check individual Third-Party Offers and review all related terms and conditions, including any privacy policies and terms of service, before redeeming any Third-Party Offer. We are not responsible for any information that you agree to share with third-party partners in connection with any such Third-Party Offers.

Forward may receive compensation from third-party partners for referring you to the third party-partner, their products or services or to their website. This compensation may impact how and where products appear on the Forward Platform, including, for example, the order in which they may appear within listing categories. Forward may not include all products or offers that may be available to you.

If you post or upload any content, data or other materials to the Forward Platform, including if you provide Financial Data by linking Linked Accounts or if you share information by linking a social media account (together, “User Content”), then you represent and warrant to us that you own all right, title and interest in your User Content, and that you have the authority or license to post, upload or otherwise share your User Content with Forward. You retain all ownership rights in your User Content, but by uploading or submitting any User Content to the Forward Platform, you grant us a non-exclusive, transferable, unlimited, worldwide, perpetual, sub-licensable and royalty-free license to use, modify, adapt, reproduce, make derivative works of, publish and/or transmit, and store that User Content and to distribute and make it available to third parties for the purposes of providing, developing, optimizing, improving and promoting or enhancing the Forward Platform or any of our Services, or any other products or services, whether offered by Forward or a third party, that may be relevant to your User Content.

As provided above, if you add users to your family circle or if you grant family members access to your Account, your User Content may be visible to other users pursuant to your Account settings and instructions. You must not post or otherwise transmit any User Content through the Forward Platform that you do not want shared with such other users.

EXCEPT WHERE PROHIBITED BY LAW, NEITHER FORWARD, NOR ITS AFFILIATES, NOR EACH OF ITS OR THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SUCCESSORS OR ASSIGNS OF EACH, SHALL BE LIABLE TO YOU FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, EVEN IF FORWARD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. UNLESS OTHERWISE EXPRESSLY SET FORTH IN A WRITTEN AGREEMENT WITH YOU, OUR MAXIMUM LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE FORWARD PLATFORM OR THE SERVICES, WHETHER IN CONTRACT, TORT OR OTHERWISE SHALL BE LIMITED TO ONE HUNDRED DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. IN SUCH STATES, LIABILITY IS LIMITED TO THE EXTENT PERMITTED BY LAW. TO THE EXTENT THAT ONE OR ANY ASPECT OF THE LIMITATIONS SET OUT ABOVE DOES NOT APPLY, ALL REMAINING ASPECTS SURVIVE.

These Terms and any dispute or claim arising out of, or related to, them or the Forward Platform will be governed by and construed in accordance with the laws of the State of California and the United States without regard to conflicts of law provisions thereof, and without regard to the United Nations Convention on Contracts for the International Sale of Goods. The jurisdiction and venue for actions related to the subject matter hereof will be the state and federal courts located in San Francisco, California, and both parties submit to the personal jurisdiction of such courts.

BY AGREEING TO THESE TERMS AND USING THE FORWARD PLATFORM, YOU ALSO WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION IN CONNECTION WITH THE FORWARD PLATFORM. THE PARTIES AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
